SNS Terms and Conditions

About these Terms and Conditions

SMBC Trust Bank Ltd. (hereinafter referred to as the "Bank") has established the following Terms and Conditions (hereinafter referred to as these "Terms and Conditions") for the management, etc., of the Bank's official social media accounts (hereinafter referred to as the "Official Accounts").

The Official Accounts have been opened by the Bank, which is a financial institution registered under the Financial Instruments and Exchange Act.
The Official Accounts are operated by the Bank while using the services of external companies such as Meta Platforms, Inc. The Facebook pages, etc., are not websites owned by the Bank and are not under the control of the Bank.

Article 1. Purpose of Use

The Bank shall use the Official Accounts for the purpose of disseminating information from the Bank to the Users (as defined in Article 4).

Article 2. Scope of Application and Revision of these Terms and Conditions

These Terms and Conditions shall apply to the Bank and the Users (as defined in Article 4) with respect to the provision and use of the Official Accounts.
These Terms and Conditions are subject to revision in the event of changes in laws and regulations, instructions from regulatory authorities, or other necessities. The Bank shall notify the Users of the fact that a certain revision will be made, details of the revised provisions, and the effective date of the revision, by posting the information on the Bank's website or by other appropriate means prior to the effective date of such revision.

Article 3. Period of Use and Management of the Official Accounts

The Users shall use the Official Accounts in compliance with these Terms and Conditions.
The Bank may change any content of the Official Accounts, or terminate any of the Official Accounts, without giving prior notice to the Users. The Bank does not promise that the Bank will update all of the Official Accounts. Any posts or comments made to the Official Accounts shall be considered public information, which shall be retained and recorded by the Bank.

Article 4. Users

The term "Users" refers to persons who have viewed or used the Official Accounts.
When a User uses any of the Official Accounts, it shall be deemed that the User has agreed to these Terms and Conditions.

Article 5. Access to Basic Information

The Bank will have access to information that is publicly available to all users in accordance with each User's SNS settings, such as the User's name and profile picture. If a User continues to use the Official Accounts, the User shall be deemed to have agreed to the privacy policy described below.

Article 6. Prohibited Acts

Each User shall be prohibited from conducting any of the acts listed below. The Bank may, without notice, delete, or take other actions against, posts or comments that fall under the categories of the prohibited acts. The Bank may block the account of the relevant User. In such cases, the Bank will not notify the relevant User.

  1. Any act that disrupts the operation of the Official Accounts, or that may otherwise interfere with the Official Accounts;
  2. Any act that causes or may cause inconvenience, disadvantage, or damage to other Users, third parties, or the Bank;
  3. Any act that infringes or may infringe on trademark rights, copyrights, or other intellectual property rights, privacy, or other rights of other Users, third parties, or the Bank;
  4. Any act that is prohibited by each SNS operating company;
  5. Any act that is contrary to the purpose of these services or unrelated to the purposes of the Official Accounts;
  6. Any act of identifying, disclosing, or leaking personal information without the consent of the relevant individual;
  7. Any act that damages the honor or reputation of a specific individual or group, or that falls under libel or slander against a specific individual or group;
  8. Any act that violates or may violate laws and regulations, or public order and morals;
  9. Any act that is considered an obscene expression;
  10. Any act that leads to or may lead to a criminal act;
  11. Any political activity, election campaign, religious activity, or any act similar thereto;
  12. Any act of impersonating a third party including the Bank; or
  13. Any other act that the Bank deems inappropriate.

If the Bank suffers damage as a result of a User's act, the Bank may demand compensation for the damage from the User.
If a User causes damage to a third party through the use of the Official Accounts, the User shall resolve the dispute at his/her own responsibility and expense.

Article 7. Intellectual Property Rights

Any copyrights and all other intellectual property rights (including, but not limited to, copyrights, design rights, patents, utility model rights, trademark rights, and know-how) in or to the information displayed on the Official Accounts shall belong to the Bank or the copyright holders or other right holders.

With respect to the contents posted on the Official Accounts, the User shall grant the Bank the right to use such contents (including the right to process, excerpt, reproduce, publish, translate, etc., such contents) free of charge, on a non-exclusive basis, and throughout the world, and shall not exercise any intellectual property rights, including copyrights and author's moral rights, against the Bank, in relation to such contents.

Each User shall not use any information provided through the Official Accounts, without the permission of the relevant right holder, beyond the scope of reproduction for the User's personal uses permitted under the Copyright Act or other uses that are not restricted under the Copyright Act. Any use of such information for commercial purposes shall be strictly prohibited.

If any dispute arises with a right holder or third party due to violation of the provisions of this Article, the User shall resolve such dispute at his/her own responsibility and expense.

Article 8. Disclaimer

Non-residents of Japan cannot use the products and services mentioned on the Official Accounts, except for certain products and services offered to non-residents of Japan.

Information on the Bank's Official Accounts is up to date as of the time when it is posted.

The Bank does not guarantee the accuracy or appropriateness of various information displayed on the Official Accounts.

The Bank shall not be held responsible for any damage or trouble suffered by the Users in connection with various information displayed on the Official Accounts or changes or updates to the display, etc., of various information. In addition to the above, the Bank shall not be held responsible for any damage, loss, disadvantage, etc., arising out of the use of the Official Accounts, except in cases where such damage, loss, disadvantage, etc., is imputable to the Bank's fault.

Depending on the User's browser type or other viewing environment, linked pages may not load properly or other viewing-related problems may occur. The Bank shall not be held responsible for any damage or trouble (including, but not limited to, loss of business profits, interruption of business, or loss of business information) arising out of the User's inability to use the Official Accounts, except in cases where such damage or trouble is attributable to the Bank's fault.

The Bank shall not be held responsible for any information, including comments, posted by a third party on pages of the Official Accounts, and the third party shall be held responsible for the information posted by it. Such information posted is not endorsed by the Bank, and does not represent the Bank's views.

Information posted by the Bank and its employees on these pages does not necessarily represent the Bank's official announcements or views. For the Bank's official announcements and views, please refer to the Bank's press releases, etc.

Social media services are operated by external companies. The Bank does not guarantee the functionality or safety of social media services. In addition, the Bank will not respond to inquiries regarding the operational status of systems of external companies, or functionalities, usage methods, or technical aspects of software or applications provided by external companies, etc.

The Bank will not respond to all comments or inquiries from the Users on these pages.

Article 9. Purpose of Use of Personal Information and Privacy Policy

Except as otherwise provided by laws and regulations, the Bank will use the Users' personal information only to the extent necessary to achieve the following purposes:

  1. To conduct analysis to improve the information distributed through the services;
  2. To conduct monitoring, deletion, etc., of any information posted that violate the provisions regarding prohibited acts under these Terms and Conditions; and to exercise rights and fulfill obligations under these Terms and Conditions; and
  3. Any other purposes of use specified by the Bank under the "approach to appropriate protection and use of personal information (Declaration of Protection of Personal Information)" established by the Bank in accordance with the Act on the Protection of Personal Information.

Article 10. Governing Law and Jurisdiction, etc.

  1. These Terms and Conditions shall be governed by, and construed and applied in accordance with laws of Japan. In the event that a dispute arises in connection with the use of the Official Accounts that cannot be resolved in accordance with these Terms and Conditions, such dispute shall be resolved through mutual consultation between the Bank and the User in good faith. In the event that a dispute arises and cannot be resolved through good faith consultation, and it becomes necessary to file a lawsuit regarding the use of the Official Accounts, the Tokyo District Court shall be the court of exclusive jurisdiction in the first instance.
  2. In the event that there is any inconsistency between the Japanese and English versions of these Terms and Conditions, the Japanese version shall prevail.
